Policy

Thank you for shopping at Smart Time Food Store website. We have highlighted some of the terms and conditions below.

Using this website constitutes an agreement to be bound by the terms and conditions set forth below. We reserve the rights to change, alter, and modify said conditions at any time without previous notice.

TERMS OF USE

By purchasing on the Smart Time Food Store website, you agree that you are a responsible adult of legal drinking age, which is 21 years of age or over.

Smart Time Food Store assumes no liability for misunderstanding or any misinterpretation of the terms of use, shipping procedures, shipping laws, and more pertaining to individual states and situations.

Smart Time Food Store is not liable for any damage to goods caused by weather conditions, accidents, or natural disasters during transportation. Other events for which we are not to be held liable include catastrophes such as, but not limited to:

  • Plane crashes.
  • Unforeseeable delays or accidents.
  • Destruction due to domestic and international unrest (i.e. riots, war, public enemies).
  • Confiscation, quarantine or natural disaster.

The experienced staff of the shipping department at Smart Time Food Store takes every precaution to insure safe transit of goods requested by our customers. 

SHIPPING

At the moment of writing this document, we only ship to most of the to addresses in California. We do not ship to the following:

  • PO Boxes
  • APO/FPO addresses
  • Any international addresses
  • Any other states outside of California 

If you place an order to be shipped to any of the areas stated above, you will receive a full refund and your order will be canceled.

We can have your order delivered to a home or business address, although a business address is often preferable.

TIME FRAMES

Your order will be processed between 1 to 3 business days before being shipped. Please be advised that during Holidays or with special releases, there might be delays in fulfilling orders. Please, be patient.

Once your order is processed, you will receive a tracking number by email where you can check the progress of the order.

We do not do shipping ourselves. Any complaints about shipping delays  should be directed to the shipping carrier assigned to your order.

CHANGING SHIPPING ADDRESS

If you need to change the delivery address of an order for any reason whatsoever, please notify us as soon as possible before the order is shipped. If the order has already been shipped, rerouting or stopping is not possible. See also cancelling an order below.

 

REFUSED ORDERS

In case you, the customer, refuse delivery of an order, you will receive a partial refund of the total of the purchased products once we receive the order back. This excludes shipping and handling expenses and a 25% restocking fee.

ORDERS RETURNED BY THE CARRIER

When orders are returned to the sender (us), it usually is due to the following factors:

  • The submitted address is wrong (No such address)
  • The address is that of an empty building or vacant lot
  • The carrier could not access the apartment or town house complex

If the carrier sends the package back, you have 48 hours to contact us if you want it reshipped to the same or different address. However, there will be a reshipping fee that must be fulfilled before we take action.

If we don't hear from the customer within the specified time frame, the same process will be applied as to that of a refused order.

LOST OR DAMAGED ORDERS DURING TRANSIT

If a package gets lost during transit, we will contact the shipping carrier to get a Lost Package confirmation. This usually takes between 2 and 3 business days after which, either the package is found or we should be able to take action. Depending on the products, we will do either of the following:

  • Refund the order, in chase the items are limited releases that we can't acquire anymore.
  • Reship the package.

Orders damaged during transit usually get sent back to us. When this happens, we have to wait for the package to be delivered to us so we can assess the damage. From there, we will proceed with actions as if the order had been lost (see above).

OTHER SHIPPING ISSUES

No holds or time sensitive requests. We ship out orders as soon as they are ready. Due to our high volume of orders we do not honor any hold requests, neither can we guarantee a specific day or time in which an order will be delivered. No exceptions.

No combined shipping. If you place multiple orders on our site, we will ship each order individually. This is in case any issues should arise with any of the orders, we can address them each separately.

No order modification / substitution. In the same topic of combined shipping, we don't accept requests to add beers to any orders. Nor do we accept request so swap one product for another.

We do not control the delivery date / time of any order. Once the package is in control of the shipping carrier, we can not alter how long it will take to be delivered, we only have access to the same information you have while tracking the order. Please track your package in the respective website.

RECEIVING

Every shipment of alcohol MUST be signed for by an adult, 21 years or older. No exceptions!

In the event that no one is available to receive the package at the time of delivery, the order may be attempted to be redelivered. You must contact the carrier for additional information regarding your shipment. If no attempt to claim the order is made or re-delivery fails, the order is returned to our warehouse.

After receiving your package, if there are any issues with your order such as damaged or missing products, you must contact us within 24 hours of receiving regarding the issue. After this period is over, we are not to be held responsible for any issues.

UPGRADES AND STOCK

Our order volume is really high and some of the items you order might run out of stock or, sometimes, beers get discontinued without previous notice. Whatever the case, we will take one of the following actions to complete your order:

  • Upgrade the missing item(s) for another product of the same style. See Upgrades below.
  • Refund the missing item(s).
  • Or, worse case scenario, refund the entire order.

CANCELLING AN ORDER

If you cancel your order before being shipped, you will receive a complete refund within 3 hours.

Shipped orders can not be cancelled or rerouted and no refunds will be provided in such scenario.

Please contact us in advance.

CUSTOMER RETURNS

If for any reason you want to return a product or package, other than it being a mistake on our behalf, you will have to cover the shipping costs of the return. Any product that has been opened cannot be returned.

Refunds, in such scenarios, will be assessed based on the circumstances of the return and the state of the returned product upon arrival.

LIMITATIONS

No rain checks. We reserve the right to limit quantities in whatever manner we see fit.

PRICE CHANGES AND DESCRIPTION ERRORS

Prices subject to change without prior notice. Smart Time Food Store is not responsible for typographical errors. We reserve the right to change incorrect pricing.

Product sizes are subject to change without prior notice. We reserve the right to change descriptions and bottle sizes when they are incorrect due to typographical errors or size changes made by brewery or winery.

WEATHER CONDITIONS

We are not liable for damages to orders due to weather conditions during shipping. Potential heat exposure during warm weather conditions and extreme cold during the winter months may damage items during shipping.

Sadly, as described in the Shipping section, we can not hold your order until weather conditions improve due to our high order volume.

UNLAWFUL ACTIVITY

Smart Time Food Store reserves the right to investigate complaints or reported violations of our Terms and Conditions and to take any action we deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties, and disclosing any information necessary to appropriate persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.
